Any citizen of India now has the right to buy land in Jammu and Kashmir
The condition of permanent local resident was dropped. Currently agricultural land cannot be purchased
Any citizen of India will now be able to buy land and live in Jammu and Kashmir. A notification to this effect was issued by the Union Home Ministry on Tuesday.
The Central Government has repealed 26 laws of the state in this regard.
According to the notification, any citizen of India will be able to buy land in Jammu and Kashmir as well as Ladakh.
The central government has dropped the precondition of permanent resident of the state in case of purchase of land.
The Modi government has taken an important step by issuing a notification.
According to the notification, any citizen of India can now buy land for a factory, house or shop in Jammu and Kashmir.
This will not require proof that he is a permanent resident of Jammu and Kashmir.
An immediate notification was issued
According to the Union Home Ministry, the land notification comes into effect immediately. The Union Territory of Jammu and Kashmir will be known as the Third Order 2020 as per the Central Law.
However, for now, provisions will continue to be made that no one from outside the state will be able to buy agricultural land.
Jammu and Kashmir Vice-Governor Manoj Sinha said that outside industries should be set up in Kashmir.
"We want outsiders to set up their businesses and industries in Jammu and Kashmir," said Manoj Sinha, Vice-Governor of Jammu and Kashmir.
However, agricultural land cannot be sold and will be owned by the people of the state.
Only a person with permanent residence in Jammu and Kashmir can buy agricultural land.
Anyone can buy land for health care as well as educational institutions and build a house there to provide services related to health care or education.

કાયમી સ્થાનિક નિવાસિની શરત પડતી મુકાઈ. હાલ ખેતીની જમીન ખરીદી શકાશે નહીં
ભારતનો કોઈ પણ નાગરિક હવે જમ્મુ-કાશ્મીરમાં જમીન ખરીદી શકશે અને વસવાટ કરી શકશે. કેન્દ્રના ગૃહમંત્રાલય દ્વારા મંગળવારે આ અંગેનું નોટિફિકેશન જાહેર કરવામાં આવ્યું હતું.
કેન્દ્ર સરકારે આ સંદર્ભમાં રાજ્યના 26 કાયદાઓને રદ કર્યા છે.
નોટિફિકેશન માં જણાવ્યા મુજબ ભારતનો કોઈ પણ નાગરિક જમ્મુ અને કાશ્મીર તેમજ લદાખમાં જમીન ખરીદી શકશે.
કેન્દ્ર સરકારે જમીન ખરીદવા ના મામલે રાજ્યના પરમેનન્ટ રહીસ ની પૂર્વ શરત પડતી મૂકી છે.
નોટિફિકેશન બહાર પાડીને મોદી સરકારે મહત્વનું પગલું લીધું છે.
નોટિફિકેશન મુજબ ભારતનો કોઈ પણ નાગરિક હવે જમ્મુ-કાશ્મીરમાં ફેક્ટરી, મકાન કે દુકાન માટે જમીન ખરીદી શકશે.
આ માટે પોતે જમ્મુ કાશ્મીર નો કાયમી સ્થાનિક રહેવાસી છે તેવા પુરાવા આપવાની જરૂર રહેશે નહીં .
તાત્કાલિક અમલમાં આવતું નોટિફિકેશન બહાર પડાયું
કેન્દ્રના ગૃહ મંત્રાલયના જણાવ્યા મુજબ લેન્ડ નોટિફિકેશન તાત્કાલિક અમલમાં આવે છે. જેને કેન્દ્રશાસિત પ્રદેશ જમ્મુ કાશ્મીર પુનઃ ગઠન કેન્દ્રીય કાયદા અનુસાર ત્રીજો આદેશ 2020 તરીકે ઓળખવામાં આવશે.
જોકે હમણાં ખેતીની જમીન રાજ્ય બહારની વ્યક્તિ ખરીદી શકશે નહિ તેવી જોગવાઇઓ ચાલુ રહેશે.
બહારના ઉદ્યોગો કાશ્મીરમાં સ્થપાય એવું જમ્મુ-કાશ્મીરના ઉપરાજ્યપાલ મનોજ સિંહાએ કહ્યું હતું.
બહારના લોકો જમ્મુ-કાશ્મીરમાં તેમના વેપાર-ધંધા અને ઉદ્યોગો સ્થાપે એવું અમે ઇચ્છીએ છીએ એવું જમ્મુ કાશ્મીર ના ઉપરાજ્યપાલ મનોજ સિંહાએ જણાવ્યું હતું.
જોકે ખેતીની જમીન વેચી શકાશે નહીં અને તેમની માલિકી રાજ્યના લોકો પાસે જ રહેશે.
ખેતીની જમીન જમ્મુ-કાશ્મીર માં કાયમી નિવાસ ધરાવતો વ્યક્તિ જ ખરીદી શકશે.
હેલ્થ કેર તેમજ શિક્ષણ સંસ્થાઓ માટે કોઈપણ વ્યક્તિ જમીન ખરીદીને ત્યાં મકાન બાંધીને હેલ્થ કેર ને લગતી સેવાઓ કે શિક્ષણને લગતી સેવા આપી શકશે.
