  •  Bill to ban land grabbing activities and related matters in the state of Gujarat
  • Land grabbing in the form will be prohibited and will be declared illegal and any activity associated with or caused by land grabbing will be an offense punishable under this Act.

  •  No one should usurp or digest land by himself or anyone else.
  •  Any person who continues to occupy the land confiscated by the government, local authority, religious or charitable organization or donated or other private person on or after the commencement of this Act shall be guilty of an offense under this Act. .
  •  Anyone found guilty of violating these rules is liable to imprisonment for a term not less than 10 years but to 14 years and a fine up to the jantri value of such property.
  •  Any person who intends to expropriate the land in violation of the provisions of this Act or in connection with the expropriation of any such land -
  •  Sells or allocates any confiscated land or shows willingness to sell or allot it or declares or possesses it for the purpose of sale or allotment.
  •  Encourages or incites a person to digest the land
  •  Uses or permits to use the expropriated land intentionally for purposes involving sale or allotment.
  •  No contract for construction of any structure or building on such land
  •  Anyone may or may not perform any of the above acts.
  •  He will be punished with imprisonment for a term not less than 10 years but a fine of up to 14 years and the value of such property.

 ગુજરાત રાજ્યમાં જમીન પચાવી પાડવાની પ્રવૃત્તિઓ અને તેની સાથે સંકળાયેલી બાબતો પર પ્રતિબંધ મૂકવા બાબત વિધેયક

  • સ્વરૂપમાં જમીન પચાવી પાડવી એ પ્રતિબંધિત રહેશે અને ગેરકાયદેસર જાહેર થશે અને જમીન પચાવી પાડવા સાથે સંકળાયેલી અથવા તેના કારણે થતી કોઈપણ પ્રવૃત્તિ આ અધિનિયમ હેઠળ શિક્ષાને પાત્ર  ગુનો થશે.
  •  કોઈપણ વ્યક્તિએ પોતે અથવા બીજી કોઈ વ્યક્તિ મારફત જમીન પચાવી પાડવી અથવા પચાવી  પડા વવી જોઈએ નહીં.
  •  આ અધિનિયમના આરંભની તારીખે અથવા તે પછી સરકારની,  સ્થાનિક સત્તા મંડળની,  ધાર્મિક અથવા સખાવતી  સંસ્થાની અથવા  દેણગી ની અથવા અન્ય ખાનગી વ્યક્તિની પચાવી પાડેલી જમીન ના કાયદેસર ભાડૂત તરીકે હોય તે સિવાય,  તેનો ભોગવટો ચાલુ રાખે,  તેવી કોઈ વ્યક્તિ આ અધિનિયમ હેઠળ ગુના માટે દોષિત  ગણાશે.
  •  આ નિયમોનું ઉલ્લંઘન કરે તેવી કોઈપણ વ્યક્તિને દોષિત  સાબિત થયેથી 10 વર્ષ કરતા ઓછી નહિ પણ 14 વર્ષની મુદ્દત સુધીની કેદની અને એવી મિલકતોની જંત્રીની કિંમત સુધીના દંડની શિક્ષા થશે.
  •  આ અધિનિયમની જોગવાઈઓનું ઉલ્લંઘન કરીને જમીન પચાવી પાડવાના ઇરાદાથી અથવા તેવી કોઈ જમીન પચાવી પાડવાના સંબંધમાં જે કોઈ પણ વ્યક્તિ -
  •  પચાવી પાડેલી  કોઈ જમીનનું વેચાણ કરે અથવા  ફાળવે અથવા તેનું વેચાણ અથવા ફાળવણી કરવા માટે આપવાની તૈયારી બતાવે અથવા જાહેરાત કરે અથવા વેચાણ  અથવા ફાળવણીના હેતુ માટે  તેનો કબજો ધરાવે.
  •  જમીન પચાવી પાડવા માટે કોઈ વ્યક્તિને ઉત્તેજન આપે અથવા ઉશ્કેરણી કરે
  •  પચાવી પાડેલી જમીન નો ઉપયોગ કરે અથવા વેચાણ અથવા ફાળવણી સાથે સંકળાયેલા હેતુઓ માટે ઇરાદાપૂર્વક ઉપયોગ કરાવે અથવા ઉપયોગ કરવાની પરવાનગી આપે.
  •  તેવી જમીન પર કોઈ માળખા અથવા મકાનના બાંધકામ માટે નો કરાર કરે
  •  કોઈપણ વ્યક્તિ પાસે ઉપર જણાવેલા કૃત્યો પૈકી કોઈપણ કૃત્યો કરાવડાવે અથવા કરાવે અથવા કરાવવાનો પ્રયત્ન કરે.
  •  તેને દોસ્તી સાબિત  થયેથી 10 વર્ષ કરતા ઓછી નહીં પણ ૧૪ વર્ષની મુદ્દત સુધીની કેદની અને એવી મિલકતોની જંત્રીની કિંમત સુધીના દંડની શિક્ષા થશે.
